Terms of Service

1. Who These Terms Cover

These Terms apply to visitors, customers, account holders, form creators, invitation creators, dashboard users, and people who access AiML Forms public pages. Respondents and invite recipients may also interact with forms, RSVP pages, SMS/MMS invitations, and poll questions created by customers.

AiML Forms is a product of Whisper AiML Inc. In these Terms, “AiML Forms,” “we,” “our,” and “us” refer to Whisper AiML Inc. “You” refers to the person or entity using the service.

2. Who We Are

AiML Forms is operated by Whisper AiML Inc., 8 The Green, Suite A, Dover, Delaware 19901, United States.

3. The Service

AiML Forms provides tools for forms, invitations, SMS/MMS messaging, dashboards, and related workflows.

These may include:

• creating and publishing public form links
• storing submitted form responses when storage is enabled
• creating SMS/MMS invitation campaigns, RSVP pages, polls, and dashboard views
• uploading invitation images and generating flyer-style event pages
• sending optional SMS alerts when forms are submitted
• using Google sign-in and Google-powered location suggestions where configured

We may update, improve, remove, or modify features from time to time.

4. Accounts and Access

You may need an account, magic link, phone verification, Google sign-in, or private dashboard link to use some features.

You agree to:

• provide accurate and complete information
• keep login links, sessions, dashboards, and admin URLs secure
• promptly update information if it changes
• accept responsibility for activity that occurs under your account, dashboard, public form, or invitation links

You must notify us promptly if you believe your account, dashboard, or admin link has been accessed without authorization.

5. Customer Content and Responsibilities

Customers are responsible for what they create, collect, send, publish, and store with AiML Forms. Customers retain ownership of their content and grant us a limited license to host, process, display, transmit, and secure that content only as needed to provide, maintain, protect, and improve the service.

Customers must:

• have the rights and permissions needed for all form content, uploaded images, recipient lists, phone numbers, respondent data, and SMS/MMS messages
• provide required notices and obtain required consents for text messaging, data collection, marketing, event communications, and regulated uses
• honor STOP, unsubscribe, opt-out, deletion, and correction requests
• avoid collecting passwords, private keys, payment card numbers, SSNs, protected health information, or other sensitive regulated data unless you have a lawful basis and required compliance controls

6. SMS/MMS and Carriers

SMS/MMS delivery depends on AiMLText, phone carriers, campaign registration, carrier filtering, recipient devices, sender inventory, and message content. AiML Forms may assign pre-registered sender numbers from inventory, rotate unavailable inventory, delay sending while registration is pending, or stop messages that appear abusive or non-compliant.

7. Connected Accounts and Third-Party Services

The service may allow you to use third-party services, including Google sign-in, Google Places, Stripe, Resend, Vercel, Neon or Postgres-compatible storage, Vercel Blob, AiMLText, Twilio, and analytics or security providers.

By using a third-party-powered feature, you authorize us to access and use the information and permissions you grant solely to operate and improve the service as described in our Privacy Notice.

Your use of any third-party service may also be subject to that provider's own terms and policies. We are not responsible for third-party services or their availability, actions, or data practices.

8. Google Data and Limited Use

If you use Google sign-in or Google-powered location features with AiML Forms, you acknowledge that we may access and use Google user data only for the purposes necessary to provide the features you request.

We do not use Google Workspace data for advertising. We do not sell Google user data. We do not use Google Workspace API data to train, improve, or develop generalized artificial intelligence or machine learning models.

Use of information received from Google APIs will adhere to the applicable Google API Services User Data Policy, including the Limited Use requirements.

9. Billing

• Invitation campaigns are paid through Stripe Checkout before sending.
• Form storage is $2.99/month per form, or $29.99/year per form with about 17% off monthly pricing.
• SMS submission alerts are $3.99/month per form, or $39.99/year per form with about 17% off monthly pricing.
• Storage and SMS alerts are separate add-ons. A form can use storage without SMS alerts.
• Subscriptions renew until canceled or ended in Stripe. If a subscription ends, AiML Forms may suspend the related paid feature.
• Additional renewal, cancellation, failed billing, and refund terms are available in the Subscription Terms.
• High-use forms may require additional pricing, especially when submission volume, storage, SMS volume, or abuse-review cost materially exceeds included usage.

10. Data and Abuse Review

AiML Forms records usage events such as publishing, checkout, submissions, alert settings, SMS outcomes, and subscription changes. We may review form purpose, field labels, submission patterns, delivery results, and hashed network signals to detect fraud, spam, unsafe data collection, billing abuse, or violations of these Terms.

11. Suspension and Removal

We may suspend, limit, remove, or refuse forms, invitations, subscriptions, sender numbers, dashboards, or accounts if we believe they violate these Terms, the Acceptable Use Policy, carrier rules, provider requirements, payment rules, security requirements, or applicable law.

• you violate these Terms or the Acceptable Use Policy
• we suspect fraud, spam, abuse, unsafe data collection, carrier non-compliance, billing abuse, or security issues
• required by law, provider rules, payment rules, carrier requirements, or legal process
• a third-party provider restriction materially affects the service
• continuing to provide the service creates legal, security, operational, or compliance risk

12. Intellectual Property and Feedback

The service, including its software, design, branding, interfaces, and related content, is owned by AiML Forms or its licensors and is protected by intellectual property laws. Except for the limited right to use the service under these Terms, no rights are granted to you.

If you provide suggestions, ideas, or feedback about the service, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use that feedback for any lawful purpose without compensation to you.

13. Disclaimers

AiML Forms is provided as a hosted software service on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied.

We do not guarantee that:

• the service will meet every requirement or expectation
• SMS/MMS messages will always be delivered, accepted by carriers, or delivered at a specific time
• forms, invitations, storage, dashboards, or provider integrations will always be uninterrupted or error-free
• customer-created forms, invitations, or messages will satisfy every legal or compliance requirement for a customer's use case

14. Related Policies and Changes

These Terms work with the Privacy Notice, Acceptable Use Policy, and Subscription Terms. We may update these Terms by posting a newer version. Continued use after an update means you accept the updated Terms.
